General Terms and Conditions (GTC) for the Lasertag Game
1. Scope of application
These General Terms and Conditions govern the contractual relationship between Blue Entertainment AG (hereinafter referred to as the “Provider”) and participants in the lasertag game (hereinafter referred to as the “Participant”).
2. Booking and participation
2.1 Participants of the lasertag game can either book on site, by telephone or via the online booking platform provided by the Provider. The acceptance to the lasertag game is concluded by the confirmation of the Provider. Participants are obliged to check the information contained in the confirmation and to inform the Provider of any errors therein.
2.2 Participation in a lase tag game is only permitted to persons who have reached the minimum age of eight (8) years and are in good health. Participants who are minors require the written consent of a legal representative. The supervision of minors during the lasertag game is the sole responsibility of their legal representatives.
2.3 The Provider reserves the right to refuse bookings or to exclude participants from participation if they violate the safety regulations or disrupt the game.
3. Implementation
3.1 Participants must arrive at least 20 minutes before the start of the booked time of the lasertag game to allow for proper instruction by the provider.
3.2 Participants are obliged to follow the Provider’s safety instructions. In case of non-compliance, the Provider may exclude Participants from further participation.
3.3 In the event of disruptions by participants or damage to property, the provider may interrupt the game or cancel its further progress. In these cases, participants are not entitled to a refund of payments already made. In the event of damage to property and loss of earnings, Participants are obliged to pay compensation.
4. Liability
4.1 Participation in the lasertag game is at the participants’ own liability, insurance is the responsibility of the participants. The Provider accepts no liability for injuries, losses or damage occurring during the lasertag game, unless they are due to gross negligence or intent on the part of the Provider. Liability for indirect damage is generally excluded. The provider is not liable for auxiliary persons.
4.2 Participants are responsible for their own actions during the lasertag game and bear the risk of injury or damage to themselves or third parties. Legal representatives are liable for minors participating.
4.3 The personal liability of the Provider’s employees or of persons acting on its behalf is excluded to the extent permitted by law.
4.4 Participants are liable for damage to the facility and equipment caused by incorrect use.
4.5 Liability by the Provider for items brought along is excluded.
5. Booking changes and cancellations
5.1 Booking changes or cancellations must be notified at least 24 hours before the scheduled match date.
5.2 In the event of cancellations made within the aforementioned period, the Provider shall refund the amount already paid. Cancellations made less than 24 hours before the appointment and no-shows will be charged the full amount.
5.3 In the event of late arrival of participants at the booked play date, the provider may shorten the play time without adjusting the price.
6. Data protection
The provider collects and processes personal data of the participants only for the purpose of the implementation of the lasertag game or the execution of the contract. The data will be treated confidentially and will not be passed on to third parties unless this is necessary for the fulfilment of the contract or due to legal provisions.
7. Jurisdiction and applicable law
These GTC are subject to Swiss law. The place of jurisdiction for disputes arising from or in connection with these GTC is Bern. Participants may only sue the provider at its registered office.
