General Terms and Conditions (GTC) for participation in the Virtual Game Arena
1. scope of application
These General Terms and Conditions govern the contractual relationship between Blue Entertainment AG (hereinafter referred to as “Provider”) and participants (hereinafter referred to as “Participants”) of a game in the Virtual Game Arena (hereinafter referred to as “VR Arena”).
2. booking and participation
2.1 Participants in the VR Arena can book their participation either on site, by telephone or via the online booking platform provided by the provider. Acceptance of the game shall be deemed to have taken place upon confirmation by the provider. Participants are obliged to check the information contained in the confirmation and to inform the provider of any errors therein.
2.2 Participation in the VR Arena is only permitted to persons who have reached the minimum age of eight (8) years and are in good health. Underage participants require the written consent of a legal representative. Only the legal representatives of minors are responsible for supervising them during their participation in the VR Arena.
2.3 The provider reserves the right to refuse bookings or exclude participants from participation if they violate the safety regulations or disrupt the game.
3. realisation
3.1 Participants must arrive at the VR Arena at least 20 minutes before the start of the booked time in order to allow for proper instruction by the provider.
3.2 Participants are obliged to follow the provider’s safety instructions. In the event of non-compliance, the provider may exclude participants from further participation.
The following regulations apply, among others, but not exclusively:
a) Persons who are not playing may not enter the pitch under any circumstances during the course of the match and must wait at a sufficient distance on the edge of the pitch;
b) Virtual obstacles must never be crossed and, if possible, not touched. Unintentional offences may result in the loss of points. Deliberate offences may result in the player being sent off;
c) Keep an arm’s length away from virtual obstacles and other players at all times;
d) In case of discomfort, nausea or dizziness, the VR headset must be removed immediately and the player must contact provider’s staff immediately;
e) Very fast movements should be avoided if possible. We recommend walking at a fast pace instead of running;
f) Before passing through virtual doors, intersections or corners, slow down and walk through them carefully;
g) Do not extend your arms in the immediate (virtual) vicinity of other players. Other players should not be touched if possible;
h) Approach other players with caution and avoid startling them;
i) If the player’s virtual avatar loses all 3 hearts, the player must carefully return to his personal safety zone and must not influence other players. Failure to do so may result in the loss of points. Repeated offences will result in a sending off;
j) The player will be charged for any wilful damage to VR hardware caused by non-compliance with the above rules;
k) Users with neurological issues should consult their doctor before playing. The game can be dangerous to their health;
l) Users must not play the game if they are tired, need sleep, are under the influence of alcohol or drugs, have digestive problems or are suffering from emotional stress or anxiety. The game can be dangerous to the health of these customers;
m) Users are advised to consult a doctor before playing if they are pregnant or elderly, have pre-existing abnormalities of spatial vision or psychiatric disorders, have a hearing impairment or other serious medical conditions;
n) Any restrictions in terms of height and weight according to existing boards or screens must be observed.
3.3 In the event of disruptions caused by participants or damage to property, the provider may interrupt the game or cancel its further progress. In such cases, there is no entitlement to reimbursement of payments already made by participants. In the event of damage to property and loss of winnings, participants are obliged to pay compensation.
4. liability
4.1 Participation in the VR Arena is at the participants’ own risk; insurance is the responsibility of the participants. The provider accepts no liability for injuries, losses or damage that occur during the game, unless they are due to gross negligence or intent on the part of the provider. Liability for indirect damage is generally excluded. The provider is not liable for auxiliary persons.
4.2 Participants are responsible for their own actions during their participation in the VR Arena and bear the risk of injury or damage to themselves or third parties. Legal representatives are liable for participating minors.
4.3 The personal liability of the provider’s employees or persons acting on its behalf is excluded to the extent permitted by law.
4.4 Participants are liable for damage to the facility and equipment caused by incorrect use.
4.5 Liability on the part of the provider for items brought onto the premises is excluded.
5. booking changes and cancellations
5.1 Booking changes or cancellations must be communicated at least 24 hours before the planned match date.
5.2 For cancellations made within the specified period, the provider will refund the amount already paid. Cancellations made less than 24 hours before the appointment and no-shows will be charged the full amount.
5.3 If participants arrive late for the booked game date, the provider can shorten the game time without adjusting the price.
6. data protection
The provider collects and processes participants’ personal data solely for the purpose of organising participation in the VR Arena game and for the performance of the contract. The data will be treated confidentially and will not be passed on to third parties unless this is necessary for the fulfilment of the contract or due to legal regulations.
7.Place of jurisdiction and applicable law
These GTC are subject to Swiss law. The place of jurisdiction for disputes arising from or in connection with these GTC is Bern. Participants may only sue the provider at its registered office.
